By submitting your information through any of our forms or communications, you expressly consent to be contacted by TANKA WEST LLC, our marketing partners, and the licensed insurance agents, agencies, and carriers with whom we share your information, at the phone number(s) and email address(es) you provided, including any wireless number, by any of the following means:

• live agent telephone calls;
• automatic telephone dialing systems (autodialers);
• prerecorded or artificial voice messages;
• SMS and MMS text messages;
• email;
• direct mail.

You acknowledge and agree that this consent applies even if the phone number(s) you provided are listed on any state or federal Do Not Call Registry, corporate Do Not Call list, or wireless number registry. 7. Intellectual Property

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TANKA WEST LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE WEBSITE OR SERVICES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

11. Binding Arbitration and Class-Action Waiver

PLEASE READ CAREFULLY. THIS SECTION AFFECTS YOUR LEGAL RIGHTS.

You and TANKA WEST LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, our website, communications, or services (a "Dispute") shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual action in small-claims court for disputes within that court's jurisdiction.

The arbitration shall be conducted in the State of Idaho, or, at your election, in your county of residence within the United States. The arbitrator's award shall be final and enforceable in any court of competent jurisdiction.

CLASS-ACTION WAIVER. YOU AND TANKA WEST LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding.

If any portion of this Section 11 is found unenforceable, the remaining portions shall remain in full force, except that the class-action waiver is non-severable and, if found unenforceable, this entire Section 11 shall be void.

12. Governing Law

These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-law principles. Subject to Section 11, any judicial proceeding shall be brought exclusively in the state or federal courts located in Ada County, Idaho, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may modify these Terms at any time by posting the revised version on our website. Your continued use of the website or services after any change constitutes your acceptance of the modified Terms.
